Zippy Hills terms and conditions of use

Version 1.0. Effective date: 6 October 2026.

These terms are the contract between you and us when you use Zippy Hills. What we do with your data is a separate document: the Privacy policy.

1. Who we are

2. What Zippy Hills is

Zippy Hills is a car racing game for iPhone and iPad, played in landscape with one finger:

  • you hold your finger down to accelerate and let go to jump over the hills; in the air, a tap does a flip, and a perfect landing gives you a boost;
  • you race against five rivals in the cups (thirteen circuits by day, at sunset, at night and in the rain), on the Free Road and in the daily challenge, a new circuit every day, the same for everyone;
  • in the daily challenge you race against ghosts: your own, other players' or that of a friend who has challenged you with a code;
  • the coins you earn by playing buy cars, trails and worlds for your garage, all of them cosmetic, and continuing a run on the Free Road;
  • the leaderboards and challenges between friends are those of Apple's Game Center.

The game is downloaded from Apple's App Store and is available in thirteen languages: Catalan, Spanish, English, French, Italian, German, Portuguese (European and Brazilian), Dutch, Japanese, Korean and Chinese (Simplified and Traditional).

By installing and using Zippy Hills you accept these terms. If you don't agree with them, don't use the app.

3. Who may use it

The app is rated 4+ on the App Store and asks for no personal data in order to work. You must be 14 or older to use Zippy Hills on your own. If you live in a country where the minimum age to consent to the processing of your data is higher, you must be that age. If you are a minor but meet the minimum age, use the app with the permission of your parent or guardian.

If you are under 14, you can play with the permission and supervision of the person who holds parental authority or guardianship over you. That person accepts these terms on your behalf and decides whether consent to statistics is given. Purchases are always made by the Apple account holder, who can use Apple's tools such as "Family Sharing" and "Ask to Buy".

The App Store 4+ rating is a rating of the content: it does not replace this age requirement.

4. No account

Zippy Hills is used with no account or sign-up and does not ask you for any personal data. Your progress is saved on your device and, if you use iCloud, in your iCloud, so that it carries over to your other devices. We have no copy of it: what leaves the device, and what for, is explained in the Privacy policy.

5. Licence to use

We grant you a personal, non-exclusive, non-transferable and revocable licence to use Zippy Hills on the devices of your Apple account, for personal, non-commercial use.

You may not: decompile, reverse-engineer or extract its code (except to the extent the law expressly allows); resell, rent or sublicense it; or use it for anything unlawful.

6. Price and in-app purchases

Zippy Hills is free, with no ads. It has optional in-app purchases:

  • four coin bags.

Everything that costs coins can be earned by playing, and the cars, trails and worlds are cosmetic: every car races exactly the same. No race ever requires you to buy anything, and a continued run does not count towards the leaderboards: nothing you buy helps you win.

  • The prices that apply are the ones the App Store shows you in your country at the time of purchase, in your currency and with the taxes that apply to you. Any price shown anywhere else is indicative.
  • Purchases are charged by Apple through your App Store account. We neither see nor receive your payment method.

7. Virtual coins

Zippy Hills coins:

  • have no value outside the app: they are not money, electronic money or any means of payment;
  • cannot be exchanged for money, transferred to another person or account, or sold;
  • are a limited licence to unlock content in the app, not your property;
  • are consumable and are not restored the way permanent purchases are. They travel with your iCloud progress if you use it; without iCloud, they are lost if you delete the app. If you erase your progress, they are erased too, and this cannot be undone.

8. Digital content, withdrawal and refunds

What you buy in the app is digital content delivered immediately, at the moment of purchase. By buying, you request that delivery begin immediately and acknowledge that, once it is delivered, you lose your right of withdrawal, in accordance with Article 103(m) of the Spanish consolidated text of the General Law for the Defence of Consumers and Users. This is without prejudice to whatever Apple offers you under its own terms.

Purchases are sold and charged by Apple through the App Store, and it is Apple that decides on refunds. Requests are made at reportaproblem.apple.com. We cannot process them or return to you any amount we have not charged.

Nothing in this clause deprives you of the rights that consumer law grants you and that cannot be waived.

9. Acceptable use

By using Zippy Hills you undertake not to try to access other people's data and not to interfere with the service or its servers. Nor may you cheat, manipulate scores or leaderboards, or use programs, modifications or bugs to gain an advantage in them: we may remove scores that look like it.

10. What Zippy Hills does NOT guarantee

  • We do not guarantee that the game will work without interruptions or errors, on every device and iOS and iPadOS version, or that it will remain available on the App Store forever.
  • Without iCloud, your progress lives only on your device: if you delete the game or your device is lost or damaged, your progress and coins may be lost, and we cannot recover them.
  • The iCloud copy, other players' ghosts, the leaderboards and the challenges depend on iCloud, CloudKit and Game Center, Apple services we do not control.
  • We may change, add or remove circuits, cups, cars, worlds, missions, challenges or game balance in updates.

11. Limitation of liability

To the maximum extent permitted by applicable law, and without prejudice to the last paragraph of this clause:

  • Zippy Hills is provided "as is" and "as available", with no express or implied warranty of fitness for a particular purpose, merchantability, accuracy, or uninterrupted or error-free operation.
  • We are not liable for loss of progress or coins caused by deleting the app or your progress, or by the loss or failure of your device.
  • We are not liable for the decisions or failures of third parties the service depends on — GameAnalytics, RevenueCat, Cloudflare, Netlify, Apple, your network operator — nor for changes to their platforms, terms or prices.
  • We are not liable for indirect damage, loss of profit, loss of business, loss of opportunity or loss or corruption of data.
  • Our total aggregate liability, on any ground and for all claims taken together, is limited to the higher of these two amounts: the amount you actually paid for the app in the twelve months before the event giving rise to it, or fifty euros.

Nothing in this clause excludes or limits liability that the law does not allow to be excluded or limited: liability for wilful misconduct or gross negligence, liability for personal injury caused by our fault, or the rights that consumer law grants you and that cannot be waived — in particular those of the Spanish consolidated Consumer Protection Act. If you are a consumer and any provision of this clause turns out to be unenforceable in your case, the rest still stands.

12. Force majeure

We are not liable for failure or delay caused by circumstances beyond our reasonable control: internet or cloud provider outages, power cuts, changes or restrictions imposed by Apple or by a platform, cyber-attacks, natural disasters, conflicts, epidemics or decisions of public authorities.

13. Third-party services and Apple's role

Zippy Hills runs on other people's platforms and services: Apple (the App Store, iOS and iPadOS, payment for purchases, iCloud, CloudKit, Game Center and the delivery of notifications), RevenueCat (purchase validation), GameAnalytics (usage statistics, only if you consent), Cloudflare (the announcements service) and Netlify (hosting of the website and the support form). Each has its own terms, and we control neither their availability nor their changes.

These terms are between you and us, not with Apple. If you downloaded Zippy Hills from the App Store, in addition:

  • Apple is not responsible for the app or its content, and has no obligation to provide maintenance or support for it.
  • The licence in clause 5 lets you use the app on Apple products that you own or control, as permitted by the Usage Rules in the App Store terms.
  • If the app fails to conform to an applicable warranty, you may notify Apple, which will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation regarding the app.
  • We, not Apple, handle any claim about the app, yours or a third party's: product liability, failure to comply with legal or consumer-protection requirements, or third-party intellectual property rights.
  • You represent that you are not located in a country subject to a United States Government embargo, or on any list of prohibited or restricted parties of that Government.
  • When you use the app, you must comply with the terms of the third parties involved (for example, those of your carrier).
  • Apple and its subsidiaries are third-party beneficiaries of these terms: when you accept them, Apple may enforce them against you.

14. Intellectual property

Zippy Hills, its code, design, texts, graphics, cars, circuits and music are ours or used under licence. The licence in clause 5 transfers no rights in them to you.

15. Term and termination

These terms apply for as long as you use Zippy Hills. You may end them at any time by deleting the app; we may end them if you breach them seriously. Clauses 11, 12, 14 and 17 survive termination.

16. Changes to these terms

We may amend these terms because of changes to the app or to the law. The version in force is always the one published at zippyhills.somia.digital, which is the one the app links to, and the date at the top moves; earlier versions stay published there, dated. Significant changes are announced inside the app, and if you don't accept them the remedy is to stop using Zippy Hills.

17. Governing law, jurisdiction and complaints

These terms are governed by Spanish law.

If you have a problem, write to us first at hola@somiadigital.com: we will try to resolve it reasonably and quickly. This step is not mandatory and takes away none of your rights or time limits. As a consumer, you may also go to the consumer information office of your municipality or the consumer service of your autonomous community and, if you live in another European Union member state, to the European Consumer Centres network. The European online dispute resolution platform closed on 20 July 2025, which is why these terms do not refer to it.

If you are a consumer, you may bring a claim before the courts of your domicile and nothing here deprives you of the mandatory provisions of your country of residence. If you are not a consumer, the parties expressly submit to the courts of Girona, waiving any other jurisdiction.

If any clause of these terms is void or unenforceable, the rest remains in force.
